RZD has submitted five Arbitration Claims at RUR 91 million against Uralkali for the use of railcars

Perm branch of Sverdlovsk Railways has filed 5 claims in the Arbitration Court of Perm Region totalling to more than RUR 91 million, against the chemical company Uralkali, the Uralkali’s 1st Quarter 2010 Report says.RZD is trying to receive fees for using its railcars by the company.
The Court has already rejected the RUR 6.5 million claim.
According to the Report, the case for RUR 6 million was scheduled for April 2, and its results were not reported. The RUR 27.7 million claim was scheduled for consideration on May 4th, the RUR 41.7 million claim had to be considered on May 5th, and the RUR 9 million claim is to be considered on May 27tth.
The Uralkali press service has confirmed to Interfax that a number of claims to recover payment for the use of wagons were filed in 2009, for the period of empty wagons idling on the RZD’s tracks waiting for Uralkali to load them. In 2009, the number of such cases was increased due to lower demand for potash at the fertilizer market, explained Uralkali.
Uralkali believes that the claims are unlawful, in particular, due to the fact that the legislation does not provide for charging in favor of RZD for those railcars which do not belong to it, the Uralkali press service said, and added that the company is going to defend its position in the court. They emphasized that there had already been a few cases when various courts ruled in favor of the chemical company.
